General Terms and Conditions of Participation and Travel**
These general terms and conditions supplement the statutory regulations and govern the legal relationship between you, as a participant in the language courses, and “Die Akademie S.L.”, Palma de Mallorca, Spain, as the language school. Please take the time to read these general terms and conditions of participation and travel carefully.

1. Conclusion of the Participation Contract
By registering—whether in writing or by email—the participant makes a binding offer to “Die Akademie S.L.” to conclude a participation contract based on the service descriptions and prices stated in the main and language travel catalogues and/or on the website [www.dieakademie.de](http://www.dieakademie.de). After receiving the registration, “Die Akademie S.L.” will process the booking without delay. The contract comes into effect upon acceptance of the registration by “Die Akademie S.L.”, which does not require a specific form. The participant will be informed of the contract’s conclusion by written confirmation/invoice from “Die Akademie S.L.”.

2. Services, Courses, Certificate of Participation, Accommodation
2.1.The scope of contractual services is based solely on the service description in the relevant course offer from the main and language travel catalogue and/or on the “Die Akademie S.L.” website, as well as the course confirmation referencing the catalogue or website, and any special requests listed as binding in the confirmation. Special requests not confirmed in writing by “Die Akademie S.L.” are not binding. “Die Akademie S.L.” points out that no language classes are held on Saturdays, Sundays, or public holidays. Lessons missed due to reasons attributable to the participant will neither be rescheduled nor refunded. Participants are responsible for requesting and collecting their certificate of participation on-site. “Die Akademie S.L.” reserves the right to change brochure or website details before contract conclusion for legitimate, substantial, and unforeseeable reasons and will inform the participant accordingly prior to booking.
2.2.Language courses usually begin the Monday following the participant’s arrival unless otherwise agreed. Classes may be conducted in groups with varying language levels. Courses should generally be booked on a weekly basis. Classes are held Monday through Friday between 09:30 and 18:30, either in the morning or afternoon, as scheduled by “Die Akademie S.L.”, and may vary weekly.
2.3. Accommodation will be provided according to the selected or available booking category in locally typical lodgings. Rooms are partially furnished and meet at least the standard of the accommodation category in the respective region. This applies similarly to host families from the middle-income bracket. Towels and personal items should be brought by the participant. Accommodation will be assigned on-site. A deposit for keys, etc., may be required locally with a receipt and will be refunded upon proper departure. Accommodation starts one day before the language course begins and ends the day after the course ends, unless otherwise agreed in writing.
2.4. If a participant chooses not to use certain services (e.g., early departure without using the accommodation), these services may be reassigned to other participants.

3. Obligations of the Participant
3.1.** Participants must behave according to local customs and follow the instructions of responsible on-site personnel. House rules and general codes of conduct must be observed. Accommodation and shared facilities must be kept tidy and cleaned regularly. All property must be returned in the same condition. Missing or damaged items are the participant’s responsibility and must be replaced or repaired. Guests not assigned to the accommodation are only permitted in common areas. Overnight stays or hosting others, as well as granting access to facilities, is only permitted with express consent from local management or the host family.
3.2. Any conduct that significantly harms the reputation of “Die Akademie S.L.” or local staff, violations of house rules, or failure to follow instructions can result in warnings or immediate expulsion from the program, or termination of the contract under section 6.2, with the consequences described therein.

4. Changes to Services and Prices
**4.1. Reasonable changes or deviations of individual services from the agreed content are allowed if they become necessary after contract conclusion and are not made in bad faith, provided they are not significant and do not affect the overall nature of the language stay. In exceptional cases, “Die Akademie S.L.” may change the participant’s accommodation at short notice.
4.2. Price increases after contract conclusion are only permitted if, more than four months before the start date, taxes or fees increase that affect course participation costs. Any increase must be proportional to the per-person cost impact. Participants will be informed immediately of such changes. Price increases after the 20th day before departure are not valid.
4.3. If the price increase exceeds 5% or a significant service is changed, the participant has the right to withdraw from the contract free of charge or request to switch to an equivalent course offered by “Die Akademie S.L.” at no additional cost. These rights must be exercised immediately upon notification.

5. Cancellation by the Participant, Rebooking
5.1.The participant may cancel the booked trip at any time before departure. The receipt of the cancellation notice by “Die Akademie S.L.” is decisive. It is recommended to submit cancellations in writing. No-shows for reasons not caused by “Die Akademie S.L.” are treated as cancellations.
5.2.If the participant cancels or fails to show up, “Die Akademie S.L.” will charge a flat cancellation fee:
* Up to 30 days before departure: 30%
* 29 to 7 days before departure: 50%
* 6 to 1 day before departure: 70%
* From departure date/no-show: 100%
It is recommended to take out travel cancellation insurance, which may cover these costs.
5.3. If the participant requests rebooking (e.g., changing the travel date, destination, accommodation, or course start), “Die Akademie S.L.” will charge a fee of €40 per participant.

6. Cancellation by the Organizer
6.1. If a minimum number of participants is required for a course and not met, “Die Akademie S.L.” may cancel the course. Participants will be informed no later than 2 weeks before the start date. Paid fees will be refunded.
6.2. If the participant seriously disrupts the program despite a warning or violates the contract (e.g., theft, drug use), “Die Akademie S.L.” may terminate the contract immediately. In such cases, the full participation fee remains due, and the participant bears the cost of return travel.

7. Warranty, Termination by the Participant, Limitation of Claims
7.1. Participants must report any deficiencies immediately. Before terminating the contract they must allow a reasonable period for remedy unless remedy is impossible, refused, or an immediate termination is justified. Legal warranty rights apply for valid claims.
7.2. Claims for non-performance or improper performance must be submitted to “Die Akademie S.L.” within one month after the scheduled end of the trip. Claims made after this deadline are only valid if the participant was not at fault for the delay or the claims are based on tort.
7.3. The participant is obligated to cooperate in mitigating or preventing damages.
7.4. Claims expire in one year from the agreed end of the trip. If negotiations about claims are ongoing, the limitation period is suspended until one party declines to continue negotiations. In that case, the limitation period resumes at the earliest 3 months later. Tort claims follow statutory limitation periods.
7.5. “Die Akademie S.L.” is not liable for damages, accidents, illnesses, losses, theft, social or political unrest, etc., during the stay abroad, including travel to and from the destination.

8. Passport, Visa, and Health Regulations
8.1. Participants are responsible for compliance with all travel-related regulations. They bear all disadvantages from non-compliance unless caused by incorrect or missing information from “Die Akademie S.L.”. Customs and currency regulations must be followed.
8.2.“Die Akademie S.L.” is not liable for the timely issuance or receipt of visas. Participants must ensure their passport or ID is valid for the trip.

9. Insurance and Vaccinations
“Die Akademie S.L.” recommends travel cancellation insurance. Each participant should review their personal insurance coverage for health (including abroad), accidents, luggage, etc. Unbinding support may be provided by “Die Akademie S.L.”. Participants are responsible for preparing all travel-related documents and vaccinations, with non-binding assistance from “Die Akademie S.L.”.

10. General Provisions, Jurisdiction
The invalidity of individual provisions does not affect the validity of the entire contract. The participant may sue “Die Akademie S.L.” only at its registered office. For lawsuits by the organizer, the participant’s place of residence is decisive, unless they are a registered merchant or reside abroad or their location is unknown—then the place of jurisdiction is “Die Akademie S.L.”’s registered office.
